高。      

購屋的金額龐大,如果不小心踩進購屋陷阱,損失可是非同小可。有些事情,房屋銷
售員或是經紀人可能不會主動告訴你,但是有「15個非問不可的問題」,購屋人付訂
金前一定要弄清楚,不但能保障自己權益,還能爭取到砍價空間。                
                                                                           
                                                                           
買預售屋                                                                   
                                                                           
行政院消費者保護委員會統計,去年上半年購屋類申訴案件有321件,占全年申訴案  
件近一成,是各類排名中的第二高,統計起來,預售屋的糾紛比率高於成屋。其中,
坪數不符、施工品質不良占最多數,想買預售屋,有10件事一定要先問清楚:       
                                                                           
                                                                           
1.
建照與產權                                                               
                                                                           
建築物興建,要先領有建造執照,才可以向建築管理機關申請開工;完成後要申報完
工,經檢驗合格才可以領取使用執照,接著才能申請接通水、電。有沒有建照?請銷
售人員亮出來吧!                                                           
                                                                           
此外,建築公司蓋房子,有時是自地自建,有時是和地主合建。如果是和地主合建,
購屋人最好分別和地主簽立土地買賣契約、與建設公司簽立房屋買賣契約,以免日後
建設公司和地主一旦發生合建糾紛時,拿不到土地產權。

稅費誰買單                                                               
                                                                           
各種稅費由誰負擔,應該在房屋買賣契約書中註明。通常所應負擔的稅費包括:土地
增值稅、契稅、地價稅、房屋稅、印花稅、水電瓦斯接戶費、產權登記費以及代書費
等,除依法令規定契稅由買方繳納、土地增值稅由賣方繳納外,其餘稅費由誰負擔,
應該在契約中明訂,以免日後發生糾紛。

公設比多少                                                               
                                                                           
如果聽到「以最低的價格買到較大的坪數」,要注意坪數沒有沒灌水。因為樣品屋沒
有樑柱、家具尺寸較小、牆壁較薄,可能會產生空間的放大效果,交屋後才發現落差
很大,可能就是銷售員把夾層坪數都算進去,因此,購買時一定要問清楚:公設比有

4.
挑高夠高嗎                                                               
                                                                           
一般房子都是<?XML:NAMESPACE PREFIX = ST1 />283的高度, 但不少房子打  
著「挑高」的名義,主要就是看準購屋人認為挑高可以做夾層的心理,但是如果是挑
36,天花板厚度就要10公分36的產品只能做成閣樓或是儲藏室,人根本不好

何時可完工                                                               
                                                                           
購屋者最關心的是交屋日期,簽約時應註明開工日期、完工期限與交屋日期,並注意

如何付貸款                                                               
                                                                           
許多建商標榜「只要自備x萬元,即可擁有美麗新家」,甚至打出保證九成銀貸的訴
求,對於自備款不足的人相當具有誘因。要注意的是,雖然建商願意接受高成數的房

7.
建材與設備                                                               
                                                                           
使用建材如電梯、廚具、地磚、衛浴設備等,建商多會在契約註明廠牌「或同等級之
建材」,但何謂同等級建材,為避免差異過大,最好在契約上註明建材內容及保固期
限範圍。通常一般設備保固期限為1年,如果契約上沒有這項條款,可以要求建商加

8.
樑柱與格局                                                               
                                                                           
室內的隔間與平面配置會影響生活起居是否舒適與方便,房間的通風與採光是否良  
好,也都是購屋人要問清楚的地方。此外,預售屋平面圖只看得到「柱」,卻看不到
樑的位置,因此有必要主動詢問銷售員,以免交屋後才發現大樑影響到空間規劃與家

管理費多少                                                               
                                                                           
有些社區完工後建設公司會輔導成立管理委員會,住戶要按月繳納管理費用,購屋人

違約責任                                                                
                                                                           
購買預售屋,從簽約到實際交屋約需經13年的時間,簽定契約時應詳加注意違約條

買成屋                                                                     
                                                                           
買成屋的糾紛多集中在產權與屋況,因此,有5個問題也是在付訂前要問清楚的:

產權與面積                                                               
                                                                           
在付出訂金前,應先到地政機關申請土地、建物登記簿謄本,查閱所有權人、面積、
有無設定抵押、或被查封等情事,避免產權有問題。此外,要詳看所有權狀,計算確

屋況看仔細                                                               
                                                                           
看房子時要注意牆壁有無漏水痕跡?附近環境如何?有無公害?決定購買時,最好有
一段緩衝時間,多看幾次並做多方面比較。                                     
                                                                           
                                                                           
3.
屋主為何賣                                                               
                                                                           
如果房子曾發生兇殺案或是自殺、地層下陷,還有國人避諱的風水問題,像是路沖  
等,屋主或經紀人多半會隱瞞,或是裝作不知情;最好在購買前多向鄰居打聽,如果
你完全沒有這些忌諱,還可以趁機向屋主殺價。                                 
                                                                           
                                                                           
4.
斡旋金多少                                                               
                                                                           
斡旋金指的就是訂金,主要是買主表現誠意,讓房屋仲介人員拿來與屋主談判的籌  
碼,通常是房屋總價的2%5%                                               
                                                                           
此外內政部也制定了不動產要約書,與斡旋金最大的不同是,要約書不必先付訂金,
而是簽訂要約書。但缺點是,買主如果反悔,容易被賣方舉證提起民事訴訟,所以購
屋人應多方蒐集資訊,確定滿意這間房子後,再下訂或簽不動產要約書,以避免付訂
後反悔產生糾紛。                                                           
                                                                           
                                                                           
5.
價格合理嗎                                                               
                                                                           
屋主通常會給經紀人一個最低限度的「委託價」,另外再開出一個高出委託價12
的「意願價」,留給購屋人殺價的空間。不過委託價到底在哪裡,通常無法得知,如
何判斷價格合不合理?基本上,只要經過嚴密的評估,認為這是自己可以接受的價  
格,又與一般行情相差無幾,就可以稱得上是合理的價格。
